Livingstone Privacy Notice

This privacy policy explains how Livingstone Technologies Limited and its group companies, where applicable (“Livingstone”, “we”, “us” or “our”), collect, use, store and share personal data. It applies when you visit our websites, use our online services or portals, enquire about or purchase products and services, attend our events, or apply for a role with Livingstone. Our websites are not intended for children, and we do not knowingly collect personal data relating to children. This policy supplements any more specific privacy or fair processing notice provided to you and does not override it. Current and former workers should also refer to the relevant internal worker privacy notice.

The information we collect

We may collect, use, store and transfer: identity data (such as name, username, job title, occupation and employer); contact data (such as business email address and telephone number); technical data (such as IP address, login data, browser type and version, time zone, operating system, platform and device information); profile data (such as account details, preferences, feedback and survey responses); usage data about how you use our websites, portals, products and services; and marketing and communications preferences. We may also create aggregated or anonymised data which does not directly or indirectly identify you. Recruitment information may include your CV, employment and education history, right-to-work information, references and other information relevant to your application. Where recruitment requires special category or criminal-offence data, we will process it only where an appropriate legal condition applies.

How we get the personal information

We collect personal data through direct interactions with you, automated technologies when you use our websites or portals, and selected third parties or publicly available sources.

Livingstone Website: When you provide your information on the ‘Contact Us’ page of our website. We may use cookies to track, gather, and aggregate information about how you access our website.

Events, Surveys and Promotions: When you register with Livingstone or request information such as whitepapers, guides, or newsletters on any Livingstone products or services. When you register to attend an event/webinar/conference via Livingstone. When you participate in an online survey, prize draw or promotions by Livingstone.

Job Application: When you apply for a position with Livingstone via the website, you will be required to provide information necessary for the recruitment process. Unless the disclosure is mandated by law, we will inform the applicant in advance whenever we wish to reveal information to a third party.

Social Media: When you visit our social media pages. However, your interactions on social media are governed by the provider’s privacy policy.

We may also receive technical data from analytics, advertising and search providers; identity and contact data from approved data providers, business partners and suppliers; and information from publicly available sources such as Companies House. How we use the information

Livingstone uses the information provided to:

• Fulfil your request for certain products or services,
• Monitor how you use our website and personalise your experience,
• Keep you up to date on the latest news, products and services, special offers, or any other relevant information we think you’d like to hear about either from us, our partners or the industry,
• Process your job application by assessing your suitability for a role with us and to monitor recruitment statistics.
• Additionally, we may utilise this data for evaluating the effectiveness of marketing, advertising, and sales efforts.

Under the UK GDPR, we will only process personal data where the law allows us to. Depending on the circumstances, we rely on one or more of the following lawful bases:

• performance of a contract with you, or taking steps at your request before entering into a contract;
• compliance with a legal obligation;
• our legitimate interests, or those of a third party, where your interests and fundamental rights do not override those interests;
• your consent, where consent is required and can be withdrawn at any time; and
• where recruitment involves special category or criminal-offence data, an additional condition permitted by data protection law.

Livingstone uses ‘Cookies’ and similar technologies which are small text files placed on your computer or device when you visit the website. Cookies are used to gather demographic information about users, track website traffic trends and analyse users’ navigation around the website so that we can improve the website and provide a better and personalised service according to your personal preferences and interests. You can control the use of cookies at the cookies setting which pops up when you view the site by either accepting or declining the cookies. You give your consent by accepting cookies. If you decline cookies, your information won’t be tracked when you visit our website, and it may limit your use of certain features or functions on our website or cookies.

Who we share your information with

We may share personal data with group companies, professional advisers, business partners, suppliers, and service providers that support our websites, portals, recruitment, communications, marketing, finance, hosting, security, and the delivery of products or services. How long we retain your information

We have data retention policies that provide information on how long personal data is kept in our IT systems. Retention periods are determined by legislation and business requirements. All information is held securely on our systems and only in accordance with our retention policies.

Where we collect behavioural data, we reserve the right to retain this data in an anonymised form when we no longer provide a service to a user or when an account has been closed.

We retain personal data only for as long as reasonably necessary for the purposes for which it was collected, including to meet legal, regulatory, tax, accounting, reporting and contractual requirements and to establish, exercise or defend legal claims. We determine retention periods by considering the amount, nature and sensitivity of the data, the risk of harm from unauthorised use or disclosure, the purposes of processing and whether those purposes can be achieved by other means. At the end of the applicable period, personal data is securely deleted or anonymised in accordance with our retention policies.

Your right to data portability

In some circumstances such as where we are carrying out processing by automated means and the lawful basis for processing is consent or the performance of a contract, you have the right to obtain a copy of your personal information in a structured commonly used and machine-readable format.

Automated decision-making and profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, where it produces legal or similarly significant effects. Livingstone does not currently use personal data for this type of automated decision-making. If this changes, we will explain the processing and apply appropriate safeguards, including human review where required.

International transfers of personal information

Livingstone may transfer personal data to group companies, business partners or service providers outside the UK. Where the destination is not covered by UK adequacy regulations, we will use an approved transfer mechanism, such as the UK International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses, and apply supplementary safeguards where appropriate. Opting out of email and selecting email preferences

You can opt out of marketing at any time by using the unsubscribe link in a marketing email or by contacting grc@trustmarque.com. Opting out of marketing will not affect service-related communications or the lawfulness of processing carried out before your request took effect.

If you would like to select the type of information you receive from marketing, you can do so by the link to update your ‘email preferences’, found in the footer of marketing emails that have been sent to you.
